To begin: I only bring to a casino the amount of cash that I'm comfortable lighting on fire. I lose with a smile, win with a grin. This isn't a case of "I gambled away my money", it's a case of severe INTERFERENCE by CASINO EMPLOYEES!! If I simply "gambled away" anything, I wouldn't be complaining to anyone.
Yesterday went to my local Indian Casino in California with BlackJack in mind.
As I laid $500 cash on the table the dealer called the Pit Boss to verify the chips. Gave me some reds ($5) and greens ($25)
THINKING BLACKJACK STRATEGY, I placed my first bet of $20. The Pit Boss then started going on and on about the benefits of their Player's Club membership....
"Sir?" the dealer asks, I redirect my attention to see the hand he dealt waiting for my decision.
I hit and lose, meanwhile the PIT BOSS keeps going on and on about comps and free money just for
"Your turn" the dealer asks as others are looking at me as I'm now trying to calculate the numbers the Pit Boss was quoting....
.... free money just for (The Pit Boss never shut up durring the entire thing) playing like I was already doing.... blah blah blah
The Pit Boss asks me for my ID, as I'm going through my pockets and trying not to hold up the table, I don't realize the amount of the bets being placed.
After the Pit Boss had my ID, I realized what had happened.... 80% of my cash had just vanished!!! I was left with only $125 after 4 minutes of "play", and had not planned to bet that heavily, at least not this early.
I complained to her directly, getting the canned "I'm sorry but you need to watch what you are betting" and "I'm not responsible for your actions" responses. (What about HER responsibility to make sure the PAYING GUESTS are treated with RESPECT)
I complained to another Pit Boss.... Canned response: "All bets placed inside the circle are a binding contract"
I complained to the senior manager and she said that I need to watch what I'm doing!! WHAT I'M DOING????? WHAT ABOUT THE CASINO'S OWN STAFF? She went on to say that the Pit Boss did absolutely nothing wrong and I should 'take it to a higher level' (her own words) and file a written complaint with the California Gaming Commission.
I then 'took it higher' and complained to the police, who took 90 minutes to arrive. After a brief and private conversation with the managers, the officer came back and said the casino told her communication is a common practice and the casino did nothing wrong!!! And went on to say that I also appear to be a person easily distracted! More like easily distracted by someone 2 feet away speaking directly to me???
Who is at fault here???? I went to the Casino only with the intent of playing cards. I certainly diddn't put $500 down at the table to think about a Players Club membership.
Also, where is the recourse for taking this case to court? Can an Indian Casino be sued in small claims??
